This panel discussion will explain how the Probate Code and the Family Code collide with respect to estate planning, the lack thereof, and dissolution actions. Ruth Koller Burke, whose practice focuses on estate planning and administration, including contentious administrations, will explain how an individual can update their estate plan prior to filing a dissolution action. Robyn Ginney, an experienced family law litigator, will explain the limitations set forth by the automatic temporary restraining orders. Ruth will then delve into the ways in which an individual can set forth their testamentary wishes after filing a dissolution action. Lia Seara, a Wealth Advisor who works with divorcing couples and individuals, will explore the various practical decisions an individual should make when planning their estate in the midst of a divorce. Jennifer Herlihy, whose practice focuses on trust and estate litigation, will share the various ways she has seen the lack of planning or poor planning backfire when someone dies in the midst of a divorce or separation.
