Participants will learn about the new developments in California Trusts and Estates law that could impact their practice and create issues for their clients. The speakers will discuss these updates as well as best practices given these changes.
About Our Speakers:
James P. Cilley is certified as a Specialist in trust and estate litigation, fiduciary disputes, and elder abuse actions by the California State Bar Board of Legal Specialization. As the senior litigation partner at Temmerman, Cilley, Kohlmann & Norcia, LLP, Mr. Cilley's practice involves will and trust contests, elder abuse, fiduciary accounting, fiduciary removal and surcharge, breach of fiduciary duty, constructive and resulting trusts, interpretation of testamentary instruments, creditor's claims, conservatorships, and related appeals. Mr. Cilley handles every stage of litigation, including pre-lawsuit negotiation, discovery, law and motion, settlement negotiations, mediation, trial, and appeals. In addition to his exceptional legal services, Mr. Cilley serves as an expert witness on a wide range of legal issues supported by current and relevant case law, statutes, and secondary resources. Mr. Cilley also serves as a mediator in trusts and estates related disputes.
Patrick A. Kohlmann is the managing partner at Temmerman, Cilley, Kohlmann & Norcia, LLP. He specializes in the areas of estate and business planning, trust and decedent's estate administration, probate, conservatorships, and related trust and estate litigation. Patrick served on the Executive Committee of the Trusts and Estates Section of the State Bar of California (TEXCOM) from 2008-2019 including a stint as TEXCOM Chair. He is a Fellow of the American College of Trust and Estates Counsel, consistently been named a Northern California “Super Lawyer”, and for the last few years has been voted as one of the "Super Lawyers" top 100 lawyers in Northern California (2021-2023). Patrick is also a CPA and an avid marathoner.
Erin A. Norcia is a partner at Temmerman, Cilley, Kohlmann & Norcia, LLP. Her practice focuses on trust, probate, and conservatorship litigation and related civil litigation. In 2019, Erin was elected on to the California Lawyers Association Trusts and Estates Executive Committee which reviews and proposes revisions to the California Probate Code, and she served as Editor-in-Chief of the California Trusts and Estates Quarterly scholarly journal. In 2022, Erin was selected as a Fellow of the American College of Trust and Estate Counsel (ACETC). Ms. Norcia is also an Adjunct Professor of the Wills & Trusts Course at Santa Clara University School of Law.
