You Inherit the Problem, Not the House. Navigating Beneficiary-Occupied Trust Real Property from Possession to Sale.

Program Summary

It is not uncommon for beneficiaries to occupy real property owned by a trust, leaving trustees in the difficult position of needing to recover possession before the property can be sold. This presentation brings together two practitioners to address the legal, transactional, and procedural issues that arise at every stage of that process from recovering possession of the property to navigating the trustee’s disclosure obligations in the sale.

About our Speakers

Samantha Sepehr has over 15 years of experience practicing in the areas of elder abuse, trust and probate litigation, and unlawful detainer matters, often representing landlords. Based in Walnut Creek, her practice is concentrated in Contra Costa, Alameda, and Solano Counties, where she regularly handles contested trust matters involving possession, occupancy disputes, and real property issues.

Vahishta Falahati is a Walnut Creek-based real estate attorney with nearly two decades of practice. Drawing on her extensive background in complex real estate disputes, she advises clients on a broad range of real estate matters, including purchase and sale transactions, and brings significant experience litigating issues involving property disclosures and nondisclosures.
